WiFi Terms and Conditions - Guests WiFi

These WiFi Terms and Conditions apply to the provision of the free internet service provided by Charles Monat Associates Pte.Ltd.

These WiFi Terms and Conditions are applicable next to other Terms and Conditions or policies, e.g. the Charles Monat Privacy Policy or the Cookie Policy and Terms of Use when visiting the Charles Monat website www.monat.com, which are deemed incorporated herein by reference.  For employees of Charles Monat Associates Pte.Ltd, these WiFi Terms and Conditions may also be applicable next to other applicable internal documents such as the Information Security Policy and contractual terms. 

Charles Monat Associates Pte.Ltd. may amend these WiFi Terms and Conditions from time to time. You should read the WiFi Terms and Conditions before registering for and/or using the internet service, Using the internet service will constitute acceptance of then applicable WiFi Terms and Conditions. Also, the internet service may change from time to time or may be fully withdrawn, at the discretion of Charles Monat Associates Pte.Ltd. 

By using our internet service, you hereby expressly acknowledge and agree that there are significant security, privacy and confidentiality risks inherent in accessing or transmitting information through the internet, whether the connection is facilitated through wired or wireless technology. Security issues include, without limitation, interception of transmissions, loss of data, and the introduction or viruses and other programs that can  corrupt or damage your computer or other devices. 

We do not guarantee the availability of the internet service, the speed at which information may be transmitted or received via the internet service, or that the internet service will be  compatible with your equipment or any software which you use.

Your use of our internet service is carried out entirely at your own risk. The service is “as is” and Charles Monat Associates Pte.Ltd. takes no responsibility for the security, confidentiality or privacy of the communication or data transmitted or received, and does not warrant that the internet service will be without failure, delay, interruption, error or loss of content or that any identified defect will be corrected or that our systems are secure. Charles Monat Associates Pte.Ltd. does not guarantee the suitability of the internet service for any specific application or purpose. 

Accordingly, you agree that the owner and/or provider of this network, including Charles Monat Associates Pte. Ltd. , is NOT liable, nor any of its affiliates, employees, agents, directors, officers, for any damage, direct or indirect or consequential, due to a security, privacy or confidentiality breach that result from use or the transmission or download of information or materials through the internet service provided. If you would be entitled to make a claim for damages, Charles Monat Associates Pte. Ltd will not be responsible in aggregate beyond SGD100. 

You shall be responsible for ensuring that the operating system and anti-virus software installed on your device are up to date, your device is compatible with the internet service.

You must not use the internet services or allow anyone else to use the internet services in an abnormal, illegal or unauthorised way. When using the internet service, you are prohibited from any activities that contravene current statutory law, infringe the rights of third parties or violate laws for the protection of minors. You must refrain from any action which might be technically harmful to the internet service or Charles Monat Associates Pte.Ltd.  If abnormal, illegal, or unauthorized behaviour is detected, the network provider reserves the right to permanently disconnect the offending device from the wireless network. Some examples of abnormal, illegal or unauthorised use are given below. 

Violations may result in demand for (1) immediate removal of offending material (2) immediate, temporary or permanent filtering, blocked access, suspension or termination of the access to the internet service. Please note that Charles Monat Associates Pte.Ltd. may report any illegal use to the relevant authorities or may take other action made available by the applicable laws. Moreover, you shall indemnify us from and against all losses, costs, liabilities and/or damages arising out of or in connection with any third-party intellectual property rights claims against us or in general in relation to your use of the internet service. 

A person (including any user) who is not a party to this service agreement has no right to enforce any of these WiFi Terms and Conditions under the Contracts (Rights of Third Parties) Act (Cap 53B). 

These WiFi Terms and Conditions shall be governed by and construed in accordance with the laws of Singapore and you agree to submit to the exclusive jurisdiction of the Singapore courts.

Examples of Abnormal, Illegal or Unauthorised Use

The following are representative examples only and do not comprise a comprehensive list of such abnormal, illegal or unauthorised usage:

  1. Spamming and invasion of privacy;

  2. Intellectual property right violations;

  3. Accessing illegally or without authorization computers, accounts, equipment or networks belonging to another party, or attempting to penetrate/circumvent security measures of another system. This includes any activity that may be used as a precursor to an attempted system penetration, including, but not limited to, port scans, stealth scans, or other information gathering activity;

  4. The transfer of technology, software, or other materials in violation of applicable export laws and regulations;

  5. Advertising, transmitting, or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards, pirating software, or making fraudulent offers to sell or buy products, items, or services;
    Uttering threats; Watching or distribution of any offensive, obscene or pornographic materials;

  6. Using the Service in violation of applicable law and regulation, including, but not limited to, advertising, transmitting, or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards, pirating software, or making fraudulent offers to sell or buy products, items, or services.

  7. High bandwidth operations, such as large file transfers and media sharing with peer-to-peer programs (i.e.torrents);

  8. Using the wireless network to transmit, post, upload, or otherwise making available defamatory, harassing, abusive, or threatening material or language that encourages bodily harm, destruction of property or harasses another;

  9. Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message;

  10. Facilitating a violation of these WiFi Terms and Conditions;

  11. Hacking;

  12. Distribution of Internet viruses, Trojan horses, or other destructive activities;

  13. Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail-bombing, or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the node or any connected network, system, service, or equipment;

  14. The sale, transfer, or rental of the wireless network to customers, clients or other third parties, either directly or as part of a service or product created for resale;

  15. Seeking information on passwords or data belonging to another user;

  16. Making unauthorized copies of proprietary software, or offering unauthorized copies of proprietary software to others;

  17. Intercepting or examining the content of messages, files or communications in transit on a data network.
